The Parliament of Australia adopting a Creative Commons NonCommercial licence

An example of a public body (mis)using (in my opinion) non-commercial clauses is the Australian Parliament. Copyright notice available here:

Their approach seems reasonably consistent with open access, however it is severely lacking from the point of view of the open government data movement.
